General notes

The operator of these pages takes the protection of your personal data very seriously. Your data will be treated confidentially and in accordance with the statutory data protection regulations for Austria and this privacy policy.

The General Data Protection Regulation (GDPR) of the European Union is abbreviated to "GDPR" in the following.

"Personal data" means information that can be used to directly or indirectly identify a natural person (Article 4(1) GDPR).

This privacy policy contains information about what data is collected and for what purpose it is used.

When using this website, various data is collected automatically, which may also be personal data. This data, such as IP addresses, is absolutely necessary so that the service requested by the user or the website itself can be made available.

The website operator attempts to protect the processed data as best as possible. Data transmission on the Internet may have security gaps due to the transmission protocols, programs or settings used. Absolute protection of data against access by unauthorized persons is therefore not possible.

What are Cookies

Cookies and data in the Local Storage are text data that are stored on your computer by the web browser. They make it possible to store data that can be retrieved the next time you access the webpage or the next time you visit the website. Cookies are used to make the website more secure and user-friendly. Local Storage essentially differs only in the method of access, but not in the purpose. Therefore, data in Local Storage is also meant here when the term "Cookies" is used.

You can configure most web browsers so that cookies are not stored, only stored temporarily or only stored with your consent. You can also delete all or only certain cookies in the web browser settings. Some web browsers also allow you to disable web technologies that can track user activity.

If cookies are deactivated or deleted, the functionality of this website may be limited.

What are Session Cookies

Session cookies are data that are stored by the web server on the web server itself. They are used for secure data exchange between the individual pages of a website without having to be transmitted via URL or in the HTTP request. This data is only stored for the current session and is automatically deleted by the web server.

General information

Responsible person

The website operator and controller responsible for the processing of personal data is Werner Rumpeltesz, with residence in A-2051 Dietmannsdorf 22, reachable by e-mail at web@gaijin.at. He decides on the purposes and means of processing personal data.

Contract for commissioned data processing

Data processing in connection with the technical operation of this website is carried out by a provider in the European Union, which makes it subject to the GDPR. A contract for commissioned data processing has been concluded with this provider in accordance with Article 28 GDPR.

Revocation of consent

You have the right to withdraw your consent at any time. An informal notification by e-mail to the website operator is sufficient for the revocation. The legality of the processing carried out on the basis of the consent is not affected until the revocation.

Right to object

Citation (Article 21(1) GDPR): The data subject shall have the right to object, on grounds relating to his or her particular situation, at any time to processing of personal data concerning him or her which is based on point (e) or (f) of Article 6(1), including profiling based on those provisions. The controller shall no longer process the personal data unless the controller demonstrates compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject or for the establishment, exercise or defence of legal claims.

Citation (Article 21(2) GDPR): Where personal data are processed for direct marketing purposes, the data subject shall have the right to object at any time to processing of personal data concerning him or her for such marketing, which includes profiling to the extent that it is related to such direct marketing.

Right of information

You have the right to information as to whether personal data relating to you is being processed. If so, you also have the right to be informed about the type of data, its origin, the purpose of processing, the storage period or the criteria for the storage period, as well as the recipients if the data is passed on.

Right to data portability

You have the right to receive the personal data concerning you, which you have provided to us, in a commonly used and machine-readable format, provided that it is processed automatically on the basis of your consent or in fulfillment of a contract. If you request the direct transfer of the data to another controller, this will only be done insofar as it is technically feasible and does not affect the rights and freedoms of other persons.

Right to rectification and completion

You have the right to request the correction or completion of your personal data if it is incorrect or incomplete.

Right to erasure and restriction

You also have the right to erasure or restriction of processing of personal data concerning you, provided that the legal requirements are met.

Right to complain

In the event of breaches of data protection law, you have the right to lodge a complaint with the Austrian data protection authority.

Automated decision making

Automated decision-making or profiling is not used.

Web server logs

The computer responsible for generating and transmitting the web pages (web server) automatically logs certain information from the requests made by the web browser.

This information includes:

This data is stored to protect against misuse of the services offered and for the purpose of tracing attacks and other criminal offenses. This data is also used for statistical purposes and to identify and rectify errors in order to improve the service. The data is analyzed both by the website operator and by the web space provider for the website operator (see "Contract for commissioned data processing"). Third-party providers, such as Google Analytics, are not used.

The basis for this data processing is Article 6(1)(f) GDPR. The processing is absolutely necessary to maintain the security and functionality of the web server and the website. There is therefore no possibility of objection. The logs are deleted at regular intervals as soon as the reason for storing them no longer applies. The enforcement of our own legal claims and compliance with statutory provisions, such as retention obligations in particular, remain unaffected.

E-mail

If you send a message to the website operator by e-mail, it will be stored for the purpose of replying to and processing your message, including any queries from both communication partners. The message usually contains, among other things, your e-mail address, the IP address of the sending computer and the message text you have entered. Messages will not be passed on without your consent.

The data will be stored by the website operator until you revoke your consent to processing, request deletion or the purpose for storage no longer applies. The enforcement of our own legal claims and compliance with statutory provisions, such as retention obligations in particular, remain unaffected by this.

Data processing is carried out with your consent and thus on the basis of Article 6(1)(a) GDPR. You can withdraw your consent at any time. The revocation can be made informally by e-mail to the website operator.

Online tools

Some online tools require or enable you to enter data that may also be forwarded to other websites or services so that the information you require can be displayed.

For example, a DNS query for a domain or IP address is forwarded to DNS servers, or a Whois query is forwarded to one or more Whois servers. If technically possible or useful, the name of the requested server is included in the displayed result.

Some online tools store your entries, including the current time and the IP address of the requesting computer. This information is absolutely necessary to maintain the security and functionality of the online tools and the website as a whole, in particular to prevent misuse or paralysis of the online offering due to excessive use of the online tools. There is therefore no possibility of objection. The logs are deleted at regular intervals as soon as the reason for storing them no longer applies. The enforcement of our own legal claims and compliance with statutory provisions, such as retention obligations in particular, remain unaffected by this.

If you provide your personal data, it will be processed and transmitted on the basis of Article 6(1)(a) GDPR.
